These Terms of Service govern the use of the website at makwellness.autos and the booking and attendance of sessions offered by MakWellnessCo LLC, a studio working from 1092 E 3250 N, Layton - 84040-6577, United States (US). By using this website, sending an enquiry, booking a place in a session or entering the studio, you agree to these terms. If you do not agree, please do not book a session or use the website.
We have written these terms to be readable. Where a phrase carries a specific meaning we explain it where it first appears. If something is unclear, the studio inbox at wellness@makwellness.autos and the studio line at +15137753369 are both open, and we would rather answer a question before a booking than settle a misunderstanding afterwards.

1. Acceptance of these terms
These terms form an agreement between you and MakWellnessCo LLC. They take effect when you first use the website or when you book a session, whichever happens first. Reading the pages without booking a session still binds you to the parts of these terms that concern website use.
If you book on behalf of another person or on behalf of a team, you confirm that you have authority to do so and that you will pass these terms to the people who will attend. That includes the sections on safety, on conduct and on cancellations.
Where a booking is made by a business for a workplace programme, the business is responsible for ensuring that the attendees have read the sections relevant to them, in particular the safety section and the section on herbal tea.
2. Definitions
In these terms, the studio means MakWellnessCo LLC. The website means the pages served under makwellness.autos. A session means any class, circle, clinic, coaching meeting, tea bar or workplace programme offered by the studio. A booking means a confirmed place in a session. The client means the person who books and attends, and includes a business that books a workplace programme.
A teacher means a person who leads a session on behalf of the studio. A practitioner means a person who leads a private appointment such as a stretch clinic. Business hours means the times published on the contact page, as updated from time to time.
Where the words include or including appear, they are followed by examples rather than a closed list, unless the context clearly requires otherwise.
3. Eligibility and age
Sessions are designed for adults aged eighteen and over. A person under eighteen may attend only with the written agreement of a parent or guardian, and the guardian must provide the contact details and accept these terms on the young person behalf. The studio may decline a booking where it believes the session is not suitable for the age or the needs of the attendee.
You confirm that the information you give when booking is accurate and that you will tell the teacher about anything that changes before the session, such as a recent injury or a pregnancy. You also confirm that you are able to enter the studio, which has a step free entry, and to take part in a session at a level you choose.
The studio may ask a person to leave a session where their presence creates a risk to themselves or to others. In that situation the studio will refund the fee for the session and will explain the reason at the time.
4. Booking and confirmation
A booking is made by sending a message through the contact page, by writing to the studio inbox or by calling the studio line. A booking is confirmed only when the studio replies with a confirmation that names the session, the date and the time. A message that has been sent but not confirmed does not hold a place.
Movement sessions are capped at eight people and tea bars at twelve. Where a session is full, the studio will offer the next available date and may keep a request on file if you ask. Places are held for the person named in the booking and cannot be transferred to someone else without the agreement of the studio.
The studio keeps a written record of each booking so that the room can be prepared. If you need to change a booking, contact the studio as early as you can. Changes are made where the calendar allows and are not guaranteed.
A booking may be declined where a session is not suitable, where a previous booking was repeatedly missed without notice, or where a request falls outside what the studio is able to offer safely. Where a booking is declined, the studio will explain why and, where possible, suggest an alternative.
5. Fees and payment
The fee for each session is confirmed at the time of booking. Fees cover the session, the use of mats, blocks and bolsters and the tea served at the bar afterwards. The studio does not add a booking fee and does not charge for a cup after class.
Payment is arranged in person or by a method described in the booking confirmation. The website does not take payment and does not store card details. Where a payment provider is used, its own terms apply to the transaction, and the studio receives only a confirmation that the payment succeeded.
Fees may be adjusted from time to time. A change does not affect a booking that has already been confirmed and paid. Where a fee has been agreed for a workplace programme, that fee stands for the date agreed, and any additional date is quoted separately.
If a payment is made in error, contact the studio within seven days and the studio will arrange a refund through the original method where that is possible.
6. Cancellations and lateness
You may cancel a booking by writing to the studio inbox or calling the studio line. A cancellation made at least twenty four hours before the session starts is refunded in full or moved to another date at your choice. A cancellation made with less than twenty four hours notice is not refunded, but the studio will offer a place at the next session of the same kind where one is available.
If you do not attend and do not cancel, the fee for the session is retained. The studio keeps groups small, and an empty place is a place that someone else could have used. Repeated non attendance may lead the studio to ask for a deposit for future bookings.
If you arrive more than ten minutes after the start of a session, the teacher may ask you to wait for the next session rather than join a room that has already settled. That decision is made gently and in the interest of everyone in the room. Where the studio turns you away for lateness, the fee is moved to another date rather than lost.
If the studio cancels a session, you will be offered a full refund or a place at the next available session, whichever you prefer. The studio will contact you using the details given in the booking and, where a cancellation is known in advance, will post a notice on the website homepage.
7. Attendance and conduct in the studio
The studio is a quiet room. We ask that phones are on silent, that conversations stay low before class and that the two minutes of silence at the start are respected. If you need to leave early, tell the teacher before the session and choose a place near the door.
Mats, blocks, bolsters and bowls are shared equipment. Clean equipment is set out before each session and is cleaned again afterwards. We ask that you do not move equipment between stations during a session, because the room is arranged so that each person has enough space.
The studio does not tolerate harassment, discrimination or aggressive behaviour. A person who behaves in a way that makes others feel unsafe will be asked to leave and may be refused future bookings. That decision rests with the studio owner, who will record the reason and inform the person in writing.
Any personal property you bring into the studio is your responsibility. The studio provides a coat rail and a bench but does not provide lockers and does not accept liability for lost or damaged items, except where loss is caused by negligence of the studio.
Photography and recording during a session are not permitted without the agreement of every person in the room. The studio occasionally takes photographs for its own records with written permission, and never includes a person face without a separate agreement.
8. Safety, health and personal responsibility
Wellness sessions are physical and involve movement, breathing and rest. You take part at your own pace and you are responsible for choosing the option that suits your body. A teacher will offer variations, but a teacher cannot feel what you feel, and you must stop whenever a movement does not suit you.
You confirm that you are in reasonable health to take part in a session. If you have a medical condition, are pregnant, have recently had surgery or have been advised by a clinician not to exercise, tell the studio before booking so that the teacher can discuss whether a session is suitable. Where the studio believes a session is not appropriate, it will say so and may decline the booking.
The studio is not a medical provider. Sessions are not diagnosis, treatment or therapy, and nothing said by a teacher should be taken as clinical advice. If you have a concern about a symptom, speak to a qualified clinician. The studio will not discourage you from seeking medical help and will refer you onward where that is the sensible thing to do.
In an emergency, the studio will call the emergency services and will share the minimum information needed to help. You may give an emergency contact at booking. If you do not, the studio will use the contact details held for your booking.
The studio carries general business insurance. That insurance does not replace your own judgment about what your body can do, and it does not extend to activities you undertake outside the studio.
9. Herbal tea and dietary matters
Tea served at the bar is made from herbal infusions. The regular tins hold nettle, chamomile, mint, rooibos and lemongrass, with a seasonal blend added in colder months. The label on each tin lists the herb and the steep time. If you have an allergy or a sensitivity, tell the teacher before the tea is served.
Herbal infusions are not medicine. Some herbs interact with medication, and some are not recommended during pregnancy. The studio does not give clinical advice about herbs and will always suggest that a person with a specific concern speaks to a clinician or a pharmacist before trying a blend.
Tea is served hot. Cups are placed on the counter and are not carried across the room by the host. Please take care when moving around the counter, especially where children are present with a guardian.
The studio does not prepare food other than the tea service. Where a workplace programme includes a tea table, the host will confirm the ingredients in advance so that the client can check them against any dietary requirements in the team.
10. Workplace reset programmes
A workplace reset is booked by a business under a separate written arrangement that sets out the date, the location, the number of attendees and the fee. These terms apply to the programme as well, except where the written arrangement says something different.
The client business is responsible for providing a safe room with enough clear floor space, for informing attendees about the programme and for making sure that anyone with a medical condition has checked with a clinician before taking part. The studio will provide mats, blocks and the tea service and will describe the space it needs before the date.
Where a programme is cancelled by the client with less than five working days notice, the studio may retain a portion of the fee to cover the cost of the date. Where a programme is cancelled by the studio, the fee is refunded in full and the studio will offer an alternative date.
Unless the written arrangement says otherwise, the client business is responsible for the behaviour of its attendees during the programme, and the studio may pause or end a session where the room is unsafe or where conduct prevents the session from continuing.
11. Use of the website
You may use the website for lawful purposes connected with learning about the studio and booking a session. You may print a page for your own reference. You may share a link to a page. You may not copy large parts of the site into another publication without permission.
You must not attempt to interfere with the operation of the website, to gain access to systems you are not authorised to use, to send automated requests that place a load on the server or to use the contact form to send spam, abusive messages or material that is unlawful.
The website is provided as it is. We work to keep it available and accurate, but we do not promise that every page will load without interruption or that every detail is current. Where a page carries a price, a time or a date, the confirmation sent by the studio takes priority over the page.
Links to other websites are provided for convenience. The studio does not control those sites and is not responsible for their content, their availability or their data practices.
12. Intellectual property
The text, layout, illustrations created in code, colour scheme and images on this website belong to MakWellnessCo LLC or are used with permission. The name MakWellnessCo LLC and the studio marks are the property of the studio. Nothing in these terms transfers ownership of any of that material to you.
You may quote a short passage with an attribution and a link to the page it came from. You may not reproduce whole pages, use the studio name to imply an endorsement or use the material for a competing service without written permission.
Sessions themselves, including the sequence of a class, the written routines handed out at the end and the tea blend cards, are the work of the studio and its teachers. A written routine may be used for personal practice and may not be republished or sold.
Where a visitor sends a message with an idea for a session, the studio may use the idea without obligation, unless a separate written agreement says otherwise. We say this plainly so that nobody is disappointed later.
13. Privacy and personal information
The studio handles personal information as described in the Privacy Policy, which is published on this website and forms part of these terms. The Privacy Policy explains what information is collected, why, how long it is kept and how to make a request about it.
By booking a session you agree that the studio may contact you about that booking using the details you provide. You also agree that the studio may keep a record of the booking for the period described in the Privacy Policy.
The studio will not add you to a marketing list because you booked a session. If you ask to be told about future sessions, that request is recorded separately and can be withdrawn at any time.
14. Limitation of liability
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence. The rest of this section applies only to the extent the law allows.
To the extent permitted by law, the studio is not liable for indirect or consequential loss, for loss of profit, for loss of business opportunity or for loss arising from a decision you made about your own health or participation. The studio is not liable for a loss caused by something outside its reasonable control.
Where the studio is liable for a loss connected with a session, the total liability for that session is limited to the fee paid for it. Where a loss is connected with a workplace programme, the total liability is limited to the fee paid for the programme.
The studio is not responsible for personal property left in the studio, for a vehicle parked outside, or for the actions of another attendee. The studio is responsible for keeping the room and the equipment in a safe condition and for teaching with reasonable care.
15. Indemnity
You agree to cover the studio for reasonable costs and losses that arise from your breach of these terms, from misuse of the website or from a claim brought by someone you invited to a session, to the extent that the loss was caused by your own act or omission.
This does not apply where the loss is caused by the studio own negligence or by a failure to follow these terms. It also does not apply to a claim that the law does not allow to be transferred in this way.
Where a business books a workplace programme, that business agrees to cover the studio for reasonable costs arising from a failure to provide a safe room or to inform attendees of the matters described in the section on workplace programmes.
16. Events outside our control
The studio may need to change or cancel a session where something outside its control makes the room unusable or unsafe. Examples include severe weather, a power cut, a water outage, a fire or a public health order. Where that happens, the studio will contact you as soon as it can and will offer a full refund or a place at another session.
The studio will not be liable for a delay or a failure caused by such an event, provided that it acts reasonably to reduce the effect and to tell people what has happened. If a substitute date is offered and you cannot attend it, the refund option remains open.
Where a workplace programme is affected, the studio and the client business will agree a new date in good faith. Neither party is required to pay a penalty for a postponement caused by an event outside its control.
17. Changes to the service and to these terms
The studio may add, change or retire a service. A class time may move and a tea bar may be rescheduled. Where a change affects a booking that has already been confirmed, the studio will contact you before the date and will offer an alternative or a refund.
These terms may be updated from time to time. The effective date at the top of the page is changed whenever the document is revised. A booking is governed by the terms in force on the date the booking was confirmed, unless the change is required by law, in which case the new rule applies from the date it takes effect.
Where a change to these terms is significant, the studio will describe it on the homepage for a reasonable period. Continuing to book sessions after a change means that you accept the updated terms.
18. Governing law and disputes
These terms are governed by the law of the State of Utah in the United States, without regard to conflict of law rules. The courts of Utah have jurisdiction over a dispute that cannot be resolved between the parties.
Before a dispute goes further, we ask that you write to the studio inbox and describe the problem. Most matters are settled in a short conversation. The studio will acknowledge the message and will propose a way forward within fourteen days.
If a conversation does not resolve the matter, the parties may agree to mediation with a neutral person before any formal step is taken. Nothing in this section prevents either party from seeking urgent relief from a court where that is necessary.
Where a visitor lives in a country whose consumer law gives a right to bring a claim in the visitor own courts, that right is not affected by this section.
19. How to reach us
Questions about these terms should go to MakWellnessCo LLC at 1092 E 3250 N, Layton - 84040-6577, United States (US). The studio inbox is wellness@makwellness.autos and the studio telephone line is +15137753369. We answer between sessions, usually on the same working day.
If a clause of these terms is found to be unenforceable, the rest of the document stays in force. If the studio does not enforce a clause on one occasion, that does not mean the clause has been given up for the future.
These terms, together with the Privacy Policy and any written booking confirmation, form the whole agreement between you and the studio for the services described. Nothing in them creates a partnership or an agency between the parties.
Thank you for reading these terms and for treating the studio with the same care that we try to bring to every session.
